Proposal for a new EU regulation on FDI screening: prospects for reform

The European Commission recently presented a proposal for a regulation to revise and strengthen the EU’s FDI rules in light of the critical issues associated with the current Regulation (EU) 2019/452.

The Commission’s goal is to broaden the scope of the EU’s FDI rules and reinforce screening. The proposal calls for new procedural rules, new minimum screening levels that Member States must ensure, and a post-closing screening mechanism that can be initiated within 15 months from completion of a given transaction.

The proposal will be examined by the European Parliament and the Council; however, Member States could implement the proposed changes – entirely or partially – before the implementation deadline expires.
