The recent legislation confirms the Italian Government’s constant attention to all matters linked to FDI screening.

The “Omnibus Decree” extends the Government’s special powers under Golden Power legislation to cases involving non-EU entities, including intra-group transactions relating to AI, semiconductor manufacturing machinery, cybersecurity, aerospace, energy storage, quantum and nuclear technologies, and food production technologies.

This means operators need to be more cautious assessing strategic aspects and even certain internal reorganisations.
And when it comes to the application of Golden Power legislation to tender procedures, further details have been introduced in terms of the timing and the procedure itself.
